Please read these Terms carefully before using the ODMO app.

1. Acceptance of Terms

By downloading, creating an account, or using ODMO, you agree to these Terms and our Privacy Policy. If you disagree, discontinue use immediately.

We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance. We will notify you of material changes via the "Last updated" date and/or an in-app notice.

2. Eligibility

You must be at least 18 years old to use ODMO. By using the app, you represent that you meet this requirement and that all information you provide is accurate and current.

3. Nature of the Service

ODMO is a lifestyle wellness and vitality tracking tool that:

• Calculates a daily Vitality Score (0–100 points) based on your sleep, activity, nutrition, and mindfulness habits
• Integrates with Apple HealthKit for automatic habit tracking (device-only)
• Provides motivational insights and personalized wellness recommendations

What ODMO is NOT:

• ❌ A medical device or diagnostic tool
• ❌ A replacement for professional medical care
• ❌ A HIPAA-covered entity or healthcare provider
• ❌ Responsible for decisions you make based on its output

4. Your Account and Responsibilities

• You are responsible for maintaining the security of your device and account
• You agree to provide accurate, up-to-date information within the app
• ODMO's Vitality Score accuracy depends entirely on the data you input and your HealthKit permissions
• You may not use the app for any unlawful purpose, attempt to reverse engineer it, or interfere with its operation

5. Apple HealthKit Integration

By granting HealthKit permissions, you acknowledge that:

• ODMO reads/writes health data locally on your device only
• HealthKit data is not transmitted to ODMO's servers
• You can revoke per-metric access at any time via iOS Settings → Health → Data Access & Devices → ODMO
• Revoking access will limit automatic tracking but will not delete your manually entered data

6. Subscriptions and Billing

ODMO offers optional Premium subscriptions for advanced tracking, personalized insights, and extended timer functionality.

Billing

• All transactions are processed securely via your Apple ID / App Store account
• ODMO does not process or store any payment information

Auto-Renewal

• Subscriptions automatically renew at the end of each billing cycle
• Your Apple ID will be charged within 24 hours before the renewal date
• To cancel, go to iOS Settings → [Your Name] → Subscriptions → ODMO at least 24 hours before the renewal date
• Deleting the app does not cancel your subscription

Free Trials

• If a free trial is offered, your Apple ID will be charged the full subscription price at the end of the trial period unless canceled beforehand
• Only one free trial per Apple ID account

Refunds

• All refund requests must be submitted directly to Apple via reportaproblem.apple.com
• ODMO does not process refunds directly

7. Intellectual Property

All content within ODMO — including the Vitality Score algorithm, Liquid Glass UI design system, visual assets, and written content — is the exclusive property of ODMO and is protected by applicable copyright and intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works based on any ODMO content without express written permission.

8. Disclaimer of Warranties

ODMO is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that:

• The app will be error-free, uninterrupted, or perfectly secure
• The Vitality Score will be clinically accurate
• Any specific health outcome will result from using the app

9. Limitation of Liability

To the maximum extent permitted by applicable law, ODMO and its team shall not be liable for any:

• Health consequences or injuries resulting from use of the app
• Decisions made based on Vitality Scores or app insights
• Loss of data or service interruptions
• Indirect, incidental, or consequential damages of any kind

Your sole remedy for dissatisfaction with ODMO is to stop using the app and, if applicable, cancel your subscription.

10. Indemnification

You agree to indemnify and hold harmless ODMO and its creators from any claims, losses, or damages — including legal fees — arising from your violation of these Terms or misuse of the app.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which ODMO is registered, without regard to conflict of law principles.

• For users in the European Union: your statutory rights under EU consumer protection law remain unaffected.
• For users in California: your rights under CCPA/CPRA remain unaffected.
